1. Grant of Licence
Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use GigaChad on any Apple-branded device you own or control, solely for personal, non-commercial purposes.
2. Restrictions
- You may not copy, modify, or distribute the App or any portion of it.
- You may not reverse-engineer, decompile, or attempt to derive the source code.
- You may not sublicense, sell, or commercially exploit the App.
- You may not use the App to develop a competing product.
3. In-App Purchases
GigaChad offers auto-renewable subscription plans (Pro and Max) through Apple In-App Purchase. All transactions are processed by Apple. Credits reset monthly and unused credits do not carry over.
4. Ownership
The App is licensed, not sold. We and our licensors retain all rights, title, and interest in the App, including all intellectual property rights.
5. Privacy
Your use of the App is subject to our Privacy Policy. Screen content captured during sessions is transmitted to our servers and OpenAI for processing and deleted immediately after use.
6. Maintenance and Support
We are solely responsible for providing maintenance and support for the App as required by applicable law. Apple has no obligation to provide any maintenance or support.
7. Warranty
We warrant that the App will perform substantially in accordance with its description. In the event of any failure, you may notify Apple for a refund. Apple has no other warranty obligation.
8. Product Claims
We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims and claims that the App fails to conform to any legal requirement.
9. Intellectual Property Claims
In the event of a third-party claim that the App infringes intellectual property rights, we, not Apple, will be responsible for the investigation, defence, and settlement.
10. Third-Party Terms
The App uses OpenAI's API. Your use of AI-generated content is also subject to OpenAI's usage policies.
11. Export Compliance
The App may not be exported into any country under US embargo or to anyone on applicable restricted persons lists.
12. Termination
This licence terminates automatically if you breach any term. Upon termination you must cease all use and delete all copies of the App.
13. Governing Law
This EULA is governed by the laws of the State of Delaware, United States.
14. Apple as Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of this EULA, and Apple has the right to enforce this EULA against you as a third-party beneficiary.
